Secretary Miller Issues Notario Violations

Las Vegas, NV – Secretary of State Ross Miller announced today the office’s enforcement of notary public violations. The office conducted a sweep of Las Vegas businesses advertising "notario" or "notario publico" and served approximately 40 notaries across the Las Vegas valley with notices of violation.

NRS 240.085 prohibits the use of the term "notario" or "notario publico" in advertising unless the notary is also a licensed attorney in Nevada. The Spanish terms are used to misleadingly advertise services beyond the scope of a notary public.

"This sweep of businesses using the words ‘notario’, ‘notario publico’ or any other form of the word in advertising is intended to protect our community from deceptive business practices," said Secretary Miller. "In the United States, a notary is not required to be an attorney and should not provide legal advice or legal services. However, in many other countries a notary is an attorney but in this country the use of the word ‘notario’ in advertisements is intended to deceive customers. Customers are led to believe the notary services that they are receiving are legal services provided by a licensed attorney, allowing the ‘notario’ to charge fees in excess of what is allowed under State law," he added.

The Secretary of State conducted its investigation based on complaints that some businesses were using these deceptive words in advertising. A notary public found in violation may face criminal proceedings, which in addition to other penalties may result in a fine up to $2,000 and the suspension or revocation of their appointment. The notaries have been given 30 days to remove all advertisements using these deceptive terms.
